The following terms and conditions apply to any transaction between Schwarz Karst Studio (a.k.a. Barb Schwarz Karst,

the Studio, or the artist) and its clients, and to clients' use of this website and Schwarz Karst Studio’s social media platforms.

CLIENTS UNDERSTAND THE FOLLOWING:

• Schwarz Karst Studio takes care to ensure that the images displayed online faithfully represent the artworks for sale. However, images of artworks may not precisely reflect the colors and shades of the original. Colors and contrast levels on the art might vary slightly due to digital viewing and diverse lighting conditions.

• In order to get a sense of the actual size of artworks, Clients should check sizes and dimensions of artworks online and/or by viewing the galleries’ link. If you wish to verify framed or unframed sizes, please contact the artist directly. Select pieces for sale include a frame, some do not, and for other pieces, framing is not necessary. If a client purchases unframed piece of artwork through Schwarz Karst Studio, and wishes to have it framed, it is the client’s responsibility to get the purchased piece framed by a professional.

• All intellectual property rights for any artworks remain with the artist who created them. Reproduction is not permitted for any reason without express permission from the artist.

• Any client purchasing Schwarz Karst Studio pieces through an art gallery or their website links shall adhere to the Terms and Conditions set forth by the gallery/galleries in which the art is being purchased. Any client purchasing art directly through Schwarz Karst Studio and/or its website shall adhere to the Terms and Conditions herein.

PURCHASING ARTWORKS

• Schwarz Karst Studio encourages its clients to think carefully before making a purchase online, and is available during regular business hours to answer questions or offer advice about potential purchases.

• It is the responsibility of the Client to contact Schwarz Karst Studio prior to purchasing a large piece to discuss shipping and insurance logistics.

• All artworks are owned by the artists who made them and held in the possession of the artist, until the client has made the payment in full. Upon Schwarz Karst Studio’s receipt of full payment and outbound shipment of the artwork, ownership risk transfers from the artist to the client.

RETURNING ARTWORKS PURCHASED FROM THE STUDIO WEBSITE / EXCHANGE POLICY

• The artist does not typically accept the return or exchange of artworks purchased once a sale has been completed; however, a refund or exchange may be possible under extenuating circumstances. The client should contact the artist via telephone within 10 days of purchasing the artwork in order to discuss these options.

• Schwarz Karst Studio & its affiliates reserve the right to offer clients a credit note or an exchange in place of a refund.

• In the unlikely event that a client is dissatisfied with an artwork once it is received, that client can cancel the purchase within 7 days of receipt via telephone by calling (406) 251-2655. Standard carrier rates apply.

• The client is responsible for all costs associated with returning the unwanted artwork, and further responsible for any loss or damage to the artwork returned to Schwarz Karst Studio. Artworks must be received by Schwarz Karst Studio in fully re-salable condition within 7-10 business days of the telephone conversation, or the client will not be reimbursed.

• Reimbursements will be issued directly to the debit or credit card used by the client for the original purchase or a merchant credit may be offered to the client in place of a refund.

COMMISSIONED PIECES AND CUSTOM ARTWORKS

• Commissioned and custom artworks require a 50% non-refundable deposit at the time of agreement between the artist and client. The remaining balance + shipping charges shall be paid in full by the client when the art piece/pieces are finished, but before the artwork is shipped. If pieces are commissioned locally (within a 15 mile radius of Missoula, Montana), contactless curbside delivery is complimentary.

• Artworks that were commissioned by the client, or customized specifically for the client, will not be refunded under any circumstances. If a client is dissatisfied with a commissioned or custom piece, they should contact the artist immediately to discuss the situation.

PERSONAL DATA

Schwarz Karst Studio may obtain clients' personal data in the course of receiving an enquiry or completing a sale. The artist will only use clients' personal data for the purposes of processing any sales and keeping them informed about relevant business. PRIVACY POLICY

This policy describes when and why Schwarz Karst Studio collects clients' personal information, how it is used, the conditions under which the artist may disclose your personal information to others and how it is kept secure. INFORMATION AND DATA COLLECTION

• Schwarz Karst Studio obtains information about its clients when clients purchase from the website, join the Schwarz Karst Studio e-newsletter mailing list, or when they make an enquiry (either in person, over the telephone, by email or via the Studio website).

• Schwarz Karst Studio may collect clients' names, addresses, email addresses and/ or telephone numbers.

• If clients purchase a product online from Schwarz Karst Studio, their card information is not held by the artist; it is collected by Schwarz Karst Studio website’s third-party payment processors who specialize in the secure online capture and processing of credit/debit card transactions.

INFORMATION USAGE

• Schwarz Karst Studio and its affiliates may use clients’ personal information to process artwork purchases.

• If clients have voluntarily joined the e-newsletter mailing list, the Studio may use client data to send information about current exhibits, artworks for sale, and other arts-related news and activities.

• Schwarz Karst Studio may use clients’ information to carry out its obligations arising from any contracts entered into by both the Studio and the client.

• The Studio may use a client's information to contact the client or prospective client regarding current or potential business with Schwarz Karst Studio.

COOKIES POLICY

• Cookies are text files containing small amounts of information which are downloaded to your device when you visit a website. Cookies are then sent back to the originating website (Schwarz Karst Studio) on each subsequent visit, or to another website that recognizes that cookie. Cookies are widely used because the allow a website to recognize a user’s device and therefore allow enhanced functionality. • If clients visit www.schwarzkarststudio.com, cookies may collect the clients' IP addresses in order to enhance the Client’s web-viewing experience. If the client disables cookies on their web browser, that client may not be able to view or use all the interactive features on our website. Otherwise, Schwarz Karst Studio assumes the client is accepting of its cookie policy.

INFORMATION ACCESS

• The owner and employees of Schwarz Karst Studio have access to collected personal information of clients.

• Schwarz Karst Studio will never sell or rent clients’ personal information to third parties. Nor will the Studio share clients' information with third parties for marketing purposes.

• The Studio may pass clients' information to its third-party service providers, subcontractors and other organizations for the purposes of completing tasks and providing services (for example to deliver a client’s purchase or to send newsletters). When the artist uses third-party service providers, it discloses only the personal information that is necessary to deliver the service.

• When you give Schwarz Karst Studio personal information, steps are taken to ensure that it is treated securely. The Studio will hold a client’s personal information in its systems for as long as is necessary for the relevant activity. Once the personal information is no longer useful, it will be securely removed from the Studio’s systems.

• When providing credit or debit card details via the Schwarz Karst Studio website, client information is encrypted and protected with 128 Bit encryption.

CLIENT OPTIONS

• Clients may choose whether or not they wish to receive information and updates from Schwarz Karst Studio. If a client does not want to receive direct marketing communications from Schwarz Karst Studio they may click the UNSUBSCRIBE link on any email to opt out.

• The artist will not contact its clients for marketing purposes by direct personal email, phone or text message unless it has a lawful basis to process client information. This means the Studio will either have a legitimate interest in contacting the client (to keep them up to date with products they have enquired about or purchased) or that the client has given explicit consent to be contacted. Schwarz Karst Studio will not contact clients for marketing purposes if they have indicated that they do not wish to be contacted.

• Upon request, clients may change their marketing preferences at any time by contacting the Studio at info@schwarzkarststudio.com or clicking UNSUBSCRIBE on email marketing newsletters to completely opt out.

• Upon request, clients may receive a copy of the personal information in which Schwarz Karst Studio holds about them. Clients may request that the artist correct any inaccurate information it holds about them (e.g. outdated home or email addresses).

• Upon request, clients may have their personal information erased from Schwarz Karst Studio’s systems, as long as there is no pressing need for Schwarz Karst Studio to keep retain it (e.g. making a payment toward an artwork purchased on a Commission).

CHANGES AND UPDATES TO TERMS AND CONDITIONS OR PRIVACY POLICY

• Schwarz Karst Studio will update clients of any updates, changes, additions or redactions to its Terms and Conditions and Privacy Policy. The most updated version is posted here-within (2026).
